Informed Consent
1. You are confirming that personal information given is to the best to your knowledge.
2. You understand that exercises during sessions will consist of one or more of the following components:
• Cardiovascular
• Resistance
• Mobility and Flexibility
• General physical activities
• Physical assessments and measurements
3. You are confirming that you will train and follow advice at your own free will.
4. You are accepting the fact that when doing exercise there are potential risks such as episodes of temporary light headedness or possible loss of consciousness, and you wilfully assume responsibility for these risks.
5. You are obliged to immediately inform the trainer of any abnormal symptoms that you may experience during exercise.
6. You may stop or delay exercise if desired. The training session may be terminated by the trainer upon observation of any symptoms of undue distress or abnormal response.
7. Brian Zammit Personal Training, and the trainers working on their behalf, will not be held liable for any damage or injury (including death) that you may suffer during training sessions or from any content given out.
8. You may ask questions, request further explanation and information about procedures at any time.
9. Personal information and data collected will not be disclosed to third parties unless requests are made by the state authorities.
10. Should there be a need to discuss with other health professionals, you will be asked to give permission to Brian Zammit Personal Training to disclose necessary information.
11. In order to ensure a better service and optimisation of delivery of sessions, trainers on behalf of Brian Zammit Personal Training will have full or partial access to your personal information and data.
12. Personal information and data collected will be discarded 120 days after your last booking.
13. Brian Zammit Personal Training confirms that the data collected is relevant and limited as much as possible. Information collected helps us plan training sessions and guide you to a healthy lifestyle. Requests to access and review data can be made at any time. This is in line with the laws of GDPR.
General
1. Children under 16 years must get consent from their parents/ guardians and be accompanied by them during the consultation.
2. Full payment for the preferred training option must be duly settled during the consultation.
3. One to One Personal Training and Single Shared Personal Training must be paid for one session upfront.
4. Paid single sessions and training packages are non-transferable and non-refundable.
5. Training packages have to be used within the respective time frame as indicated at the time of purchase. Unused sessions will be lost and cannot be refunded.
6. When buying a new package before the active one has expired, unused sessions will be included in the new package.
7. A credit note valid for 3 months can be given for paid packages that remain unused for a maximum of 14 days from the date of purchase. Packages that include unused sessions are not entitled to this arrangement.
8. Training packages will be extended when the premises are closed on full days, for any eventuality which is in the control of Brian Zammit Personal Training and when the state authorities enforce gyms to be kept closed.
9. Training packages will not be extended when the premises are closed in eventualities that are beyond Brian Zammit Personal Training control:
• war and civil upraising (even if not enforced by state authorities),
• nationwide electrical power cuts,
• inaccessibility of sanitary facilities due to damage to the national water and/ or drainage systems,
• inaccessibility to the building due to:
a. natural disasters (tornados and severe storms, flooding, earthquake),
b. damages caused by third parties,
c. accidental fire, lighting, and explosion,
d. court inquiries.
10. Sessions lost due to national power cuts (planned or unplanned) will not be replaced.
11. It is your responsibility to book, delete, and move sessions from the website www.brianzammitpersonaltraining.com.
12. Booking is obligatory. Without booking, you will be accepted for sessions only if there is space available at the gym.
13. It is advisable to book sessions at least 24 hours in advance. There will be no guarantee that an updated session plan is ready if the booking is not done by this timeframe. The use of the facility will be allowed and a past session plan will be repeated.
14. Session plans must be left at the gym.
15. Cancellation Policy: You can cancel your training session six (6) hours prior to the set appointment from the booking system on the website.
16. When a booking can no longer be cancelled, it is still possible to move it during the same day.
17. It is your responsibility to remove waiting list requests if not needed any longer.
18. Synchronisation of bookings with your email calendar through the universal calendar format (.ics) is an additional feature that may be removed at the discretion of the operator. Brian Zammit Personal Training is not responsible for any errors related to this feature. The official means to confirm bookings is via the website's booking functionality.
19. Being late for a session will result in lost time from your training slot.
20. In order to safeguard your health, and that of other members and trainers you will not be allowed to participate in training sessions:
• when having a temperature of more than 37.2⁰c,
• when having a resting systolic blood pressure of 180mmHg and/ or diastolic blood pressure of 100mmHg,
• when blood glucose is above 16mmol/l,
• with uncontrolled resting tachycardia (100 BPM and above),
• if experiencing pain, dizziness, or excessive breathlessness during exertion,
• if having other uncontrolled or unstable physical and/ or mental conditions,
• if seen as visibly unwell to carry out the training session.
The session will still be deducted from your training package, if not cancelled as stated in the cancellation policy (Point 15).
21. Brian Zammit Personal Training reserves the right to stop any member from attending the gym at any time if the member:
• damages equipment neglectfully,
• does acts of vandalism at the property,
• wilfully damages the property of other members and trainers,
• is involved in physical and verbal aggression of any kind both at the gym and surrounding area which is considered risky to other members and trainers,
• physically, verbally, or emotionally harasses other members and trainers,
• does not comply with the training advice given and is of danger to themselves, other members, and trainers,
• does not comply with the Terms and Conditions stated in different sections.
No refund for unused sessions will be given if a member is stopped from attending sessions for any of the unlawful acts mentioned. The member can be prosecuted and requested personal details by state authorities will be given.
22. You must get a large towel and wear appropriate clothing and footwear for the sessions.
23. No slamming of weights and equipment is allowed at the gym.
24. All equipment used during sessions should be put back in its place.
25. Opening days are from Monday to Saturday.
26. Prices, opening days, and opening hours are subject to change.
27. Should opening days and hours be reduced, the validity of training packages will be adjusted accordingly.
28. Mobiles, electronic devices, and other valuables should be kept in the lockers provided. Brian Zammit Personal Training and trainers on their behalf will not be liable for any losses or breakages which can happen.
29. Brian Zammit Personal Training reserves the right to end any training package being offered, at any time.
30. The results of any training programme cannot be guaranteed, and progress will depend on your effort and cooperation during and outside any training arrangement.
31. All sessions can be photographed and filmed. Footage will be used for promotional purposes on various media. Should you not wish to feature, kindly inform the respective personnel beforehand.

33. Personal information collected on our website is in accordance with our privacy policy and is used to provide and improve the service being provided.
34. The premises are monitored by CCTV. Footage will only be used in case of any wrongdoing and to check for the good running order.
35. Terms and conditions listed in all the different sections are subject to change as deemed necessary by Brian Zammit Personal Training.
